Terms and conditions:
-Payment for all goods (new and used) shall be made in full prior to collection or shipment of said goods.
-Payment for repairs and/or maintenance shall be made in full on or before the 20th day of the month following the date of the invoice.
-The Customer agrees to pay interest on all sums unpaid after the due date at the rate of 25% per annum calculated on a daily basis from the due date to the date of actual payment.
-The Customer agrees to pay all expenses, disbursements, legal costs and debt collection agency fees incurred by The Mower Shed arising from the failure to pay for any goods sold by The Mower Shed to the Customer.
-Title of all goods shall not pass to the customer until payment is made in full. If payment is not made in full by the due date, The Mower Shed reserves the right to retake possession of the goods.
-The Customer agrees that until payment is made in full The Mower Shed will have a Security interest in the goods.
-The Customer agrees and acknowledges that title in the goods remains with The Mower Shed even if the goods are incorporated in any property of the Customer and if the goods are mixed with and become a constituent part of other goods.
-The Customer gives irrevocable authority to The Mower Shed to enter any premise for the purpose of removing and retaking possession of any goods if payment is not made in full by the due date or in the event that it becomes apparent for any reason that the Customer will not make payment in full by the due date.
-The liability of The Mower Shed for any loss, damage of injury arising directly from the sale of any goods, or the defect in any goods, and any consequential loss is limited to the replacement or repair cost of the goods. This clause relates directly to the sale of new machines and/or parts and does not cover the sale of used or second hand machines or parts which are sold as ‘parts or repair’.
-No loss or damage or any claim under warranty for any goods shall be covered under warranty unless an official order is sought from The Mower Shed prior to the commencement of any repairs. All such orders must be confirmed in writing.
-The Mower Shed reserves the right to amend prices and specifications of any goods at any time without notice.
-Any Quotation given by The Mower Shed for the supply of goods and/or services is valid for 7 days from the date of its issue. Any quotation may be altered by The Mower Shed at any time in any circumstances which are beyond the control of The Mower Shed and all goods are sold at price prevailing at the date of delivery.
-The Mower Shed shall not be liable for any delay or failure to perform any obligation, including the non-delivery or late delivery of goods, if the cause of delay or failure is beyond the control of The Mower Shed.
-The guarantees contained in the Consumer Guarantees Act 1993 are excluded where the Customer acquires goods for the purpose of a business within the terms of Sections 2 and 43 of the Act.
-Where any goods are sold or traded by the Customer to The Mower Shed as a trade in or in part payment for any goods, the Customer warrants that the goods are free from any charges and encumbrances and that they are owned in full by the Customer.
-These terms are the full terms between the Customer and The Mower Shed and no representation or conditions shall be binding unless recorded in writing and signed by The Mower Shed and the Customer.
